Terms of Service

FormaOS is software for builders, remodelers, designers and home improvement companies. It helps you manage leads, proposals and projects, and gives your clients a portal where they can follow their project, review documents and make decisions.

In these terms, "you" means the company that holds the account and the people it invites. "Your clients" means the homeowners and other people you invite into a portal or send a proposal to.

• You need to be at least 18 and give us accurate information.
• Keep your sign-in secure. You're responsible for what happens under your account and for the people you invite to it.
• Tell us right away at help@getformaos.com if you think someone got into your account.

New accounts get a 7-day free trial with full access. Before the trial ends, we'll ask you to choose a paid plan to keep using FormaOS. If you don't, your account is paused. We keep your data for at least 30 days after that so you can come back or export it.

One free trial per company. We may end a trial early if it's being misused.

• Paid plans are billed in advance, monthly or yearly, and renew automatically until you cancel.
• Prices are listed on our pricing page and don't include taxes, which we'll add where required.
• If you add a payment method, you authorize us and our payment processor to charge it for your plan and any renewals. If a payment fails, we may pause your account until it's fixed.
• We may change prices. We'll give you at least 30 days' notice by email, and the new price applies from your next renewal.

Everything you and your clients put into FormaOS (leads, proposals, photos, files, messages, client details) is your content. You own it. You give us permission to store, process and display it only to run the service for you, keep it secure and support you.

You're responsible for having the right to upload your content and to add your clients' information, including any notice or consent the law requires. When we handle your clients' personal information, we do it on your behalf as described in our Data Processing Addendum, which is part of these terms.

You can export your data at any time while your account is active.

FormaOS lets your clients accept proposals, change orders and other documents by typing their name. You and your clients agree that these electronic signatures and records have the same effect as signing on paper, as allowed by the U.S. ESIGN Act and state law.

Any agreement made through FormaOS is between you and your client. We're not a party to it, we don't review it, and we're not responsible for its terms, the work, payments between you, or any dispute about them. It's up to you to make sure your documents meet the rules for your trade and location, such as contractor licensing and home improvement contract requirements.

Some features use AI to draft text, summarize activity or answer questions about your account. AI can be wrong. Read and edit anything it writes before you send or rely on it. Nothing is sent to a client without a person on your team choosing to send it. We don't allow our AI provider to train its models on your content.

You agree to follow our Acceptable Use Policy. We may suspend accounts that break it, especially when it puts other people or the service at risk.

• We own FormaOS, its software and its design. These terms don't give you any rights to them beyond using the service.
• We work to keep FormaOS running and secure, but we can't promise it will always be available or free of errors. We may change or improve features over time. If we remove something important, we'll let you know.
• If you send us feedback or ideas, we can use them without owing you anything.
• Some parts of FormaOS rely on other providers, listed on our Subprocessors page. Their services may have their own terms.

You can cancel any time from your account. We may suspend or end your account if you break these terms, don't pay, or if the law requires it. Where we reasonably can, we'll give you notice and a chance to fix the problem first.

After your account ends, you have 30 days to export your data. After that we delete it, except for what we must keep by law or in routine backups, which are deleted on their normal schedule.

FormaOS is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. FormaOS is a tool for running your business. It isn't legal, tax, financial or construction advice.

To the extent the law allows, neither of us is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim related to FormaOS is limited to the amount you paid us in the 12 months before the claim, or $100 if that's more.

Some places don't allow these limits, so they may not all apply to you.

You agree to defend and cover us against claims from third parties, including your clients, that come from your content, your work, your agreements with your clients, or your breaking these terms or the law.

These terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts in Los Angeles County, California, and both of us agree to those courts. Before filing anything, please email us at help@getformaos.com so we can try to sort it out first.

We may update these terms. If a change is significant, we'll tell you by email or in the app at least 30 days before it takes effect. Using FormaOS after that means you accept the new terms.

These terms, together with the policies linked here, are the whole agreement between us about FormaOS. If any part can't be enforced, the rest still applies. If we don't enforce something right away, we haven't given up the right to. You can't transfer this agreement without our consent. We can transfer it as part of a merger or sale of our business.
